FINRA fines Apex Clearing $250,000 over margin account supervision failures

FINRA censured clearing firm Apex Clearing Corporation and fined it $250,000 after finding the firm monitored hundreds of thousands of retail margin accounts one at a time instead of as a combined position for each customer. The settlement, a Letter of Acceptance, Waiver and Consent dated November 3, 2026, covers supervisory failures that ran from January 2020 through January 2023.

What happened in the Apex Clearing case

Apex Clearing, a FINRA member since 1983 with CRD number 13071, provides correspondent clearing services and carries customer accounts for introducing broker-dealers on a fully disclosed basis. FINRA opened the matter from a routine cycle examination. The regulator found Apex lacked a supervisory system reasonably designed to achieve compliance with Regulation T and FINRA Rule 4210, the core margin rules for securities accounts.

The firm accepted a censure and the $250,000 fine without admitting or denying the findings. AWC No. 2021069321001 resolves the matter at the firm level; no individual broker was named.

The scale of the margin supervision gap

The AWC shows how fragmented the oversight became. Between January 2020 and June 2022, more than 270,000 introduced retail customers held multiple margin accounts through their introducing firms, totaling approximately 712,000 margin accounts. About 61,000 of those customers carried margin balances across roughly 152,000 separate accounts.

Measure Count
Retail customers with multiple margin accounts 270,000+
Total margin accounts in scope ~712,000
Customers carrying margin balances ~61,000
Accounts carrying margin balances ~152,000
Customers with three or more accounts ~18,000
Individuals with ten or more accounts 130

Roughly 18,000 customers with balances held three or more margin accounts, including 130 individuals with ten or more. By monitoring each account in isolation, Apex could not see how much borrowed money a single customer actually controlled across the firm.

Why margin aggregation matters

Margin rules limit how much customers can borrow against their securities. When a firm evaluates each account separately, one customer can carry far more total debt than any single account suggests. FINRA noted that for customers actively trading across multiple accounts during the day, Apex could not reasonably monitor whether combined positions satisfied margin requirements.

The firm began tracking and aggregating customers’ multiple margin accounts by January 2023, which closed the gap the regulator identified. The stakes are rising: FINRA adopted new intraday margin standards, replacing pattern day trading margin requirements, effective June 4, 2026. Real-time supervision of margin activity now matters more for clearing firms than ever.

Apex Clearing’s regulatory history

BrokerCheck lists 49 disclosures for Apex Clearing, a large record for a clearing firm that serves introducing brokers across the industry. The margin AWC is the latest entry on a file that already includes six-figure sanctions.

BrokerCheck entry Sanction
Margin supervision AWC, November 2026 Censure and $250,000 fine
Prior AWC involving supervisory systems Censure and $3.2 million fine
Prior AWC involving SEC Rule 10b-16 Censure and $250,000 fine

Investors can review the firm’s full record through BrokerCheck under CRD number 13071. A clearing firm sits behind the introducing broker whose name appears on customer statements, so its supervisory record deserves the same scrutiny as the broker’s.

What investors should do now

Customers of introducing brokers that clear through Apex do not choose their clearing firm directly. A few checks still apply. Review monthly statements for total margin debt across all accounts held at one firm. Confirm that stated margin requirements reflect combined positions, not single accounts. Check a firm’s BrokerCheck record before opening any margin account.
